PLACING ORDERS ON THE PLATFORM
WHO CAN MAKE ORDERS
To place orders on the Platform you must be at least 18 years old, or the higher age required under applicable law to enter into a contract with AQUARIA TECH SRL,
and be a retailer NOT a consumer.
RIGHT OF AQUARIA TECH SRL TO REFUSE YOUR ORDER OR CANCEL A CONTRACT
Fulfillment of all orders on the Platform is subject to availability. We expressly reserve the right not to accept your order for any reason.
We also reserve the right to cancel a Contract by notifying you in writing.
DATA VERIFICATION
When you transmit your order to us, we may carry out certain checks before the order is processed. Such checks may include verification of your address and
anti-fraud checks. We perform semi-automated checks on all purchases to filter out unusual or suspicious transactions or transactions that can be identified as being at risk of fraud.
Alleged fraud on the Platform will be investigated and prosecuted if necessary.
PRICE/PAYMENT
METHODS OF PAYMENT
You can find the payment methods available for each country in the assistance section of the site PAYMENT METHODS. We do not accept any payment methods other than those indicated
in the above-mentioned section. Please do not attempt to pay by other means than those specified. Should this happen, we shall not be liable for loss of payment or
for any damage that might be caused by such action.
PAYMENT PROCESSING
If payment is made by credit/debit card, we will debit your account before your order leaves our warehouse.
If payment is made by bank transfer, shipment will take place after receipt of payment. This may take a few days.
If payment is made by cash on delivery, the order will be processed immediately.
If payment is made by paypal, the order will be processed after receipt of payment.
In the event that payment is not received within 12 calendar days following the transmission of the order, your order will be automatically cancelled.
Payments can only be processed if the billing information can be verified.
TRANSFER OF OWNERSHIP
The product(s) shall remain our property until we have received full payment for said product(s).
PRICES AND CURRENCY
The prices of the products shown on the Platform are exclusive of VAT. Shipping costs are applied per order.
Shipping costs depend on the weight and volume of the goods purchased. See the TRANSPORT DETAILS section for details of shipping costs.
TOTAL PRICE
The total price shown in the final checkout screen includes taxes and shipping costs.
This price will be stated in the Order Confirmation, which we recommend you print or download for future reference.
PRICE CHANGES
The price of the products will be as indicated on the Platform. Prices may vary from time to time, but variations will not affect orders already confirmed in our
Order Confirmations.
SHIPPING AND DELIVERY
DELIVERY - WHERE AND WHEN
We do not ship on certain public holidays. Please consult the service section of the Site to check delivery dates and times.
PRODUCT CONTROL ON DELIVERY
Upon delivery, please check that the packaging has not been damaged. If it appears that the products have been damaged, please sign with reservation or do not
accept the shipment.
RETURNS AND CANCELLATIONS
ORDER CANCELLATION BEFORE DELIVERY
You may cancel orders free of charge and without justification, provided that they have not yet been shipped. Orders placed with our online store are processed
almost immediately.
If the status of your order is 'In Progress' or 'Pending', you can cancel your order by contacting our call centre. Our customer service operator will request the
cancellation of your order at our warehouse. If the outcome is positive, an e-mail will be sent to you and the cancellation will be free of charge. If it is not possible to proceed with the cancellation,
the product(s) will be delivered to you and you may return them in accordance with the procedure set out below.
RETURN OF ORDERS AFTER DELIVERY - DEFECTIVE PRODUCTS
You have the right to return products delivered to you if they are defective or otherwise not in conformity with your order when you receive them. If your request is
justified, the purchase price and shipping costs will be refunded.
RIGHT OF WITHDRAWAL
If for any reason you are not satisfied with the products you have ordered, you may exercise your statutory right of withdrawal. You may exercise your right of withdrawal
informing us of your intention to return the product within 30 calendar days of delivery of the product to you or to a third party indicated by you (other than the carrier).
If you make use of your right of withdrawal, you are obliged to return the products to us promptly and in any event no later than 10 calendar days from the date on which you informed us of
your intention to make use of your right of withdrawal.
Make sure that the products you return are complete (e.g. both items forming a pair must be returned) and that they have not been used in any way if
not to the extent reasonably necessary to decide whether you want to keep the products.
INFORMATION ON REFUNDS
If you paid by bank transfer, you must give this information to Customer Services when you start the return procedure so that we can process the return
of the amount directly to your account. For practical information on how to return and for refund times, please contact us.
OTHER IMPORTANT CONDITIONS
We may transfer your rights and obligations resulting from a contract to another organisation, but this will not affect your rights and obligations resulting from these Conditions
of Sales.
You may only transfer your rights or obligations arising from these Conditions of Sale to others with our written consent.
APPLICABLE LAW/COMPETENT COURT
You agree that the Platform, the Conditions of Sale and any dispute between you and AQUARIA TECH SRL shall be governed in all respects by Italian law.

CONDITIONS OF USE

These Conditions constitute a legally binding agreement between you and AQUARIA TECH SRL and its affiliates.

Let us recall a few important points:
Our Terms may be subject to change. Some jurisdictions do not allow unilateral updates or changes to the Terms for consumers,
therefore, this paragraph may not apply to you. We may update these Conditions from time to time. In the event of material changes, we will post a notice on the Platform
or we will send you a communication. Please read any changes carefully and if you do not agree with them, please discontinue use of the Platform.
If you continue to use our Platform after being notified of the changes, it will be assumed that you have accepted the updated Terms and Conditions,
to the maximum extent permitted by law.
Conditions of Sale. By making purchases with us you also accept the applicable Conditions of Sale.
- BASIC RULES
Eligibility. You may only use the Platform if you have reached the age of majority in your country of residence or if you have the authorisation of a parent or guardian.
Rules for Registration The registration of your account is subject to the following rules:
Sincerity: Provide accurate and current registration information.
First person registration: Your registration must be personal. Do not register with more than one account; do not register an account on behalf of others,
do not give up your account.
Security: Protect your user name, password and other login credentials and do not allow others to use your account.
Liability: Inform AQUARIATECH immediately of any unauthorised use of your account. You shall be responsible for everything that happens through your account
with or without your consent. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AQUARIATECH SRL SHALL NOT BE LIABLE FOR ANY LOSS OR ACTIVITY ARISING FROM YOUR USE OF
UNAUTHORISED ACCESS TO YOUR ACCOUNT.
- CONTENT PROPERTIES
With the exception of User Content (as defined below), all content on our Platform - including text, software, scripts, code, drawings, graphics, photos, sounds,
music, videos, applications, interactive features, articles, news stories, stickers, general graphics and other content ('Content') - are the property of AQUATIA TECH SRL
or third parties from whom we have licensed the Content, and are protected by copyright, trademark, patent and other laws. AQUARIA TECH reserves all rights not
expressly set out in these Conditions.
All trademarks, service marks and trade names (e.g. the name AQUARIA TECH SRL and OUR LOGO) are the property of AQUARIA TECH SRL , registered.
By accessing or using the Platform or Content, you do not acquire any licence or ownership rights to any trademarks, service marks or trade names.
You agree not to modify or delete proprietary information from materials downloaded or printed from the Platform.
To the extent that AQUARIA TECH SRL approves the download or use of the Content including copyrights, AQUARIA TECH SEL grants you a limited, personal licence,
non-transferable, non-sublicensable and revocable access to and use of such copyrights or copyright works solely for the purpose for which they are
intended for and only for as long as such Content is normally made available to customers by AQUARIA TECH SEL . You shall not acquire any ownership rights to the Content
(including trademarks or other intellectual property included in the Content) and all Content should be considered for personal, non-commercial use. AQUARIA TECH SRL reserves the right
to monitor your use of it and to modify or revoke this licence or your access to the Content at any time and for any reason. AQUARIA TECH SRL reserves the right
the right to remove any Content that violates these Terms or NIKE's intellectual property rights. The consent of AQUARIA TECH SRL to such limited use shall not
shall constitute a waiver of any of NIKE's rights in the Content.
Unauthorised use of Content may constitute a violation of copyright, trademark or other intellectual property laws and may result in charges
and criminal or civil penalties against you.
- PUBLISHING CONTENT ON THE PLATFORM
User Content Licence. On certain parts of the Platform you may post comments. AQUARIA TECH SRL is not responsible for User Content posted by others on the
Platform. The User Content is owned by you or by whoever created it, but with the publication of the User Content is licensed to AQUARIA TECH SRL
as indicated below:
You declare that you have the right to publish your User Content, and you grant AQUARIA TECH SRL a non-exclusive, perpetual, transferable, sublicensable licence,
royalty-free, worldwide use of any User Content posted by you on or in connection with the Platform, including images of persons appearing in the Content
User, or any concept or idea contained in the User Content, for any purpose, including for commercial use, which includes the right to translate, display, reproduce, modify,
create derivative works, sublicense, distribute and assign such rights. AQUARIA TECH SRL may, at its sole discretion, remove User Content at any time.
You understand that deleted User Content may remain in the AQUARIA TECH SRL systems and on the Platform to the extent that your User Content has been made public or
shared with others who have not deleted it, unless you or the data subject requests the deletion or blocking of personal data in accordance with applicable law.
LICENCE FOR THE USE OF COMMENTS, FEEDBACK AND IDEAS. You understand that all comments, feedback and ideas you send us are provided on a non-confidential basis and you grant AQUARIA TECH SRL
a perpetual, worldwide licence to use all comments, feedback and ideas you share with us, without receiving any notice, compensation or acknowledgement, for any purpose,
including, but not limited to, the development, production and marketing of products and services and the creation, modification or improvement of products and services.
- USER CODE OF CONDUCT
We are excited about your participation in the AQUARIA TECH SRL community. Please find below some basic rules:
Act in a safe manner.
Do nothing that could expose AQUARIA TECH SRL or its users to any kind of damage, including that which could disrupt, damage, disable, alter,
overload or limit the functionality of the Platform.
Do not post User Content that contains viruses, programs or other computer code, and do not break or modify the Platform's software or security technology.
Unless otherwise indicated by us, our Platform is a public place. Do not post any personal data about yourself or others on the Platform.
Act in a personal manner.
Do not publish advertising, propaganda or commercial content on the Platform and do not accept payment from third parties in exchange for conducting commercial activity on the
Platform.
Do not collect or request personal information from other Platform users and do not send unsolicited messages.
Do not use automated technologies to interact with the Platform.
Maintain appropriate behaviour. Respect the community and do not post User Content, links to websites, or engage in illegal, deceptive, malicious or harassing behaviour,
unfair, discriminatory or otherwise reprehensible or inappropriate or which contravene applicable laws. AQUARIA TECH SRL has the right - but not the obligation - to screen them in advance,
monitor or remove User Content.
- COPYRIGHT INFRINGEMENT
We encourage you to consult your legal adviser before filing any claims as you may incur penalties for fraudulent claims.
AQUARIA TECH SRL may close the accounts of Platform users who infringe the copyrights of third parties.
- PARTNERS ON THE PLATFORM
Occasionally, AQUARIA TECH SRL may connect or associate with third party ("Third Parties") sites, social media platforms, mobile apps and other products and services.
It will be possible to connect to such Third Parties through the Platform, but this does not mean that AQUARIA TECH SRL supports, monitors or controls such Third Parties or their activities,
which are subject to separate terms of use and privacy policies. We encourage you to carefully review the terms of use and privacy policies of third-party sites.
AQUARIA TECH SRL is not responsible for the content, policies or activities of Third Parties and interactions with Third Parties occur at your own risk.
AQUARIA TECH SRL may suspend or modify the AQUARIA TECH SRL Platform, the membership programme, products or services at any time without prior notice.
AQUARIA TECH SRL may close or suspend your account, delete your profile or any of your User Content, and restrict your use of all or part of the
Platform at any time for any reason, without any liability on the part of AQUARIA TECH SRL, subject to applicable law.
You understand and accept that some User Content, particularly that displayed in activity fields or other public places on the Platform, may continue to be displayed
to the public even after your account has been closed, without prejudice to your right to have your User Content removed upon request in accordance with the
applicable law.
These Conditions shall remain in force even after you close your account or stop using the Platform.
- DISPUTES / ADDITIONAL CONDITIONS
Applicable law/Jurisdiction
You agree that the Platform, the Terms, the Privacy Policy and any dispute between you and AQUARIA TECH SRL shall be governed in all respects by the laws of Italy.
Except as prohibited by applicable law, and without prejudice to the statutory rights of consumers, you agree that all disputes, claims and legal proceedings
directly or indirectly resulting from or inherent to the Platform (including but not limited to the purchase of AQUARIA TECH SRL products) shall be terminated individually
without recourse to any form of collective action, and exclusively in the courts.
By using the Platform you agree to receive certain electronic communications from AQUARIA TECH SRL, in accordance with applicable law.
You agree that all notices, agreements, disclosures or other communications that AQUARIA TECH SRL will transmit to you in electronic form shall meet all the requirements
of legal communication, including the requirement of written form.
Right of assignment, Waivers, Severability
AQUARIA TECH SRL may assign its rights and obligations under these Conditions to any party at any time without notice to you, except if
such disclosure is required by applicable law; however, this shall not affect your rights or obligations under these Terms.
AQUARIA TECH SRL's failure to insist on or enforce timely performance of these Conditions shall not constitute a waiver of any of these Conditions or rights
of AQUARIA TECH SRL. The User shall always consider these Conditions as applicable.
In the event that any provision of these Conditions is deemed invalid or unenforceable, the remaining Conditions shall continue to apply.
